Heard learned counsel for the applicant and learned AGA for

the State as also perused the record.

The present revision has been filed against the order dated

17.01.2018 passed by the A.C.J.M., Khurja, Bulandshahr and to

stay the further proceedings of Case No. 374 of 2011 (State Vs.

Vikas and others), under Sections- 419, 420, 467, 468, 471, 34

I.P.C., Police Station- Khurja Nagar, District- Bulandshahr by

which the applicant's discharge application filed under Section

239 Cr.P.C. has been rejected.

While the applicant had been enlarged on bail he had moved the

aforesaid application stating that the applicant was only a

marginal witness in the agreement to sell and registered sale

deed executed in pursuance thereto. He had no part to play in

the allegation made against one Tridev @ Sonu under Sections-

419, 420, 467, 468, 471, 34 IPC.
