1. Heard Mr. Jitendra Singh, learned counsel for the applicant, Mr. Deepak Mishra, learned Additional Government Advocate representing the State and Mr. Ashish Gupta, learned counsel appearing on behalf of the complainant.

2. By means of this application under S.439 of CrPC, applicant - Ravi Singh, who is involved in Case Crime No. 177 of 2024, under S.498A, 304 - B IPC and Section ¾ Dowry Prohibition Act, Police - Station Madanapur, District Shahjahanpur, seeks enlargement on bail during the pendency of trial.

3. Brief facts of the case, which are required to be stated are as under: -
3.1. Earlier, Smt. Swati (now deceased) during her lifetime had lodged an F.I.R. No. 198 dated 18.09.2022 for the offence under S.498A, S.323, S.504, S.312 IPC and Section ¾ Dowry Prohibition Act against her in - laws including the applicant (husband of deceased). 3.2. In the above case, after culmination of the investigation, charge - sheet dated 14.12.2022 was submitted against the applicant as well as his father and mother.
3.3. Smt. Swati had also filed a Case No. 739 of 2022 under S.125 CrPC against the applicant before the family Court - 1st Ghaziabad, in which on 03.04.2024 a compromise took place between them and thereafter, applicant took his wife - Smt. Swati to his house on the same day, but on 28.05.2024, she died her unnatural death.
3.4. Thereafter Smt. Sangeeta Devi, who is mother of deceased - Swati lodged a first information report No. 0177 on 30.05.2024 at 21:35 hours for the alleged offence under S.498A, 304 - B IPC and Section ¾ Dowry Prohibition Act against seven accused persons, namely, Ravi Singh, Hoshiyar Singh, Mamta, Sheetal, Aman, Pappi and Vipin, who are husband, father - in - law, mother - in - law, sisters - in - law, brother - in - law

4. The above first information report No. 0177 dated 30.05.2024 is the subject matter of challenge in the present bail application.

5. Learned counsel for the applicant submits that the applicant is husband of the deceased and his marriage was solemnized with Smt. Swati (now deceased) on 16.02.2022 and she was happy in her matrimonial home. On 01.04.2022, she felt pain in her stomach, therefore, her ultrasound was done on the same day, in which, it was revealed that she has intra uterine pregnancy of ten weeks three days (73 days), whereas her marriage was performed with the applicant on 16.02.2022, only about 44 days ago, therefore, the applicant as well as his family members questioned about her pregnancy of about ten weeks, on which she did not reply and went to her parental home, and thereafter, lodged the F.I.R. on 03.04.2022 against the applicant and his family members on the false and concocted story, in which, after culmination of investigation, charge sheet was submitted against the applicant as well as his mother and father. The said charge - sheet was challenged by the accused persons through an Application u/s 482 CrPC No. 9456 of 2023, in which, interim protection was granted to the applicant's mother and father, whereas relief as sought on behalf of the applicant was refused, and thereafter, he surrendered and applied for bail. So far as proceedings under S.125 CrPC is concerned, it is submitted that in the said proceeding, compromise had taken place between the applicant and his wife on 03.04.2024, and thereafter, they also participated together on two dates in the said proceedings but the deceased did not raise allegation against the applicant and his family members regarding her alleged harassment in her matrimonial home.
