Ravi Singh v. State of U.P.


1. Heard Mr. Jitendra Singh, learned counsel for the applicant, Mr. Deepak Mishra, learned Additional Government Advocate representing the State and Mr. Ashish Gupta, learned counsel appearing on behalf of the complainant.

2. By means of this application under S.439 of CrPC, applicant - Ravi Singh, who is involved in Case Crime No. 177 of 2024, under S.498A, 304 - B IPC and Section ¾ Dowry Prohibition Act, Police - Station Madanapur, District Shahjahanpur, seeks enlargement on bail during the pendency of trial.

3. Brief facts of the case, which are required to be stated are as under: -
3.1. Earlier, Smt. Swati (now deceased) during her lifetime had lodged an F.I.R. No. 198 dated 18.09.2022 for the offence under S.498A, S.323, S.504, S.312 IPC and Section ¾ Dowry Prohibition Act against her in - laws including the applicant (husband of deceased). The F.I.R. in verbatim is reproduced herein under: -

3.2. In the above case, after culmination of the investigation, charge - sheet dated 14.12.2022 was submitted against the applicant as well as his father and mother.
3.3. Smt. Swati had also filed a Case No. 739 of 2022 under S.125 CrPC against t
