1. This Court entertained the writ petition on 29.01.2026 while passing the following orders:

"1. On 25.11.2025, the following order was passed.-

"1. Contention of learned counsel for the writ petitioner is that as per the order passed by District Basic Education Officer, writ petitioner's entitlement for honorarium from 01.09.2016 to 31.03.2018 has been admitted but on account of paucity of fund, the payment is not being made.

2. Sri Vijay Lal, learned Standing Counsel shall seek instructions and also apprise about the timeline when the payment shall be made.

3. Put up this case as fresh on 4.12.2025."

2. Thereafter, on 04.12.2025, the following order was passed.-

"1. Put up as fresh on 18.12.2025.

2. In the meantime, learned Standing Counsel to comply with the order dated 25.11.2025.

3. In case instructions are not received, the District Basic Shiksha Adhikari, Bareilly shall remain present before this Court on the next date fixed."

as under.-

"1. Contention of learned counsel for the writ petitioner is that as per the order passed by District Basic Education Officer, writ petitioner's entitlement for honorarium from 01.09.2016 to 31.03.2018 has been admitted but on account of paucity of fund, the payment is not being made. 2. 2. On 04.12.2025, the following order was passed.- "1. Put up as fresh on 18.12.2025. 2. In the meantime, learned Standing Counsel to comply with the order dated 25.11.2025. 3. In case instructions are not received, the District Basic Shiksha Adhikari, Bareilly shall remain present before this Court on the next date fixed."

3. Today, Sri R.S. Umrao, learned Standing Counsel submits that he has no instructions despite communication dated 05.12.2025.

4. Let bailable warrant be issued to the District Basic Shiksha Adhikari, Bareilly.

5. Put up this case on 29.01.2026, as fresh."

4. Today, a civil misc. extension application along with the affidavit of District Basic Education Officer, Bareilly has been filed. The Court has been apprised that Smt. Vinita claiming herself District Basic Education Officer, Bareilly is present before this Court.

5. After going through the personal affidavit of District Basic Education Officer, Bareilly, the Court finds that the same is totally unsatisfactory, no plausible explanation has been set forth regarding non payment of the honorarium particularly when it is not disputed till now regarding payment of the honorarium to the writ petitioner. The Court has been also apprised while inviting attention towards para 9 where the scheme of the Central Government has come to an end.

6. Let a personal affidavit be filed by Secretary, State Literacy Mission, U.P, Lucknow within two weeks showing the timeline and the step so taken for making the payment.

7. Put up this case on 17.02.2026 in the additional cause list at 2:00 P.M. 8. In case, affidavit is not filed by the Secretary, State Literacy Mission, U.P, Lucknow before the next date, he shall appear in person.

9. Sri Prashant Kumar Mishra, learned Standing Counsel has identified Ms. Vinita, District Basic Education Officer who is present in the Court.

Her presence for the time being is being dispensed with, however, if required, the Court may summon her."

A personal affidavit has been filed by Secretary, State Literacy Mission, U.P., Lucknow, respondent no. 1 dated 16.02.2026, according to which, necessary correspondences have been made for allocation of the budget and as soon as budget shall be allocated the remain honorarium period from 01.09.2016 to 31.03.2018 shall be paid to the writ petitioner.
