ORDER:

This Criminal Petition is filed under Section 438 Cr.P.C. to grant anticipatory bail to the petitioner/accused in Crime No.1 of 2023 of S.Kota Police Station for the offences under Section 354, 323, 506, 509 I.P.C. read with section 3(1)(r), 3(1)(s), 3(2)(va) of SC ST POA Act on 10.01.2023.

The case of the prosecution briefly is that on 09.01.2023 at about 4.30 PM, the petitioner abused the de facto complainant by using her caste name by stating as ‘Mala Langa Kuthara’ and pushed her with his hands on her chest and slapped but meanwhile her mother came to her rescue and thereby the petitioner kicked her with legs and bet her and also threatened them with dire consequences.

However, the petitioner contends that he fought for human rights being activist of civil rights and so he took steps to question the activities of Revenue Officers on several occasions and also filed writ petition No.37726 of 2022 against K.
