...RESPONDENTS Counsel for the Petitioner(s): DEEPIKA GADDE Counsel for the Respondents: N ASHOK KUMAR 2024:APHC:771 The Court made the following: ORDER THE HON’BLE SRI JUSTICE HARINATH.N WRIT PETITION No.1864 of 2004
ORDER:
The petitioners are aggrieved by the in-action of the respondents in absorbing the petitioners 4, 7, 22, 26, 28, 32, 40, 41, 42, 45, 60 and 61 in any establishments such as Irrigation and Genco. They are specifically aggrieved with the absorption of juniors to them, who were subsequently regularized. The petitioners claim for the relief of grant of retirement benefits and pension to the retired petitioners and death benefits to the dependents of the deceased employees. The petitioner`s claim that the respondents have violated the GOMs.No.212, dated 29.03.1979, GOMs.No.212, dated 20.04.1994, GOMs.No.130, dated
18.03.1981.
2. The petitioners submit that the petitioners were working as employees in Balimela Dam project. The said project a joint project between State of Andhra Pradesh and Orissa. An agreement dated 30.09.1962 was executed between State of Andhra Pradesh and State of Orissa, whereby the cost of the project and staff was to be shared on a ratio of 50% :: 50%. It is stated in the pleadings that Government of Andhra Pradesh did not recruit the full strength capacity of 50% employees at any point of time from State Quota out of 3215 work charged //2//
employees who were taken into the project only 277 work charged employees are taken from the State of Andhra Pradesh which comes to only 9%.
3. It is also stated that there have been retrenchments of Andhra Employees from time to time and those who were retrenched absorbed in various departments in the State of Andhra Pradesh. The juniors were retrenched and absorbed in various Government Departments in Andhra Pradesh, however seniors were engaged in the project site even after completion of project. The project was completed in the year 1978, those workers who were continuing at the project site towards maintenance works continued to work as work charged employees without any regularization.
4. The petitioners claim that great injustice is meted out to work charged employees as most of them have completed 10 years of service in total for being eligible for service benefits. The learned Senior Counsel appearing for the petitioners submits that GOMs.No.212, dated 22.04.1994 and GOMs.No.130, dated 18.03.1981 have been merrily flouted by the respondents. The petitioners approached the Hon’ble Lokayuktha, Hyderabad and filed a complaint No.1112 of 1995/B1 seeking regularization and consequential benefits. As on the date of approaching the Lokayuktha 98 work charged employees were in service in //3//
Balimela Joint Project and out of the said 98 workmen 61 employees have approached the Lokayuktha.
5. The Lokayuktha vide its order dated 09.05.2001 directed the respondents to regularize the services of the petitioners with all consequential benefits within a period of three months, however, the respondents did not comply with the directions of Lokayuktha, as such the petitioners filed WP.No.4699 of 2003 and this Court dismissed the writ petition with an observation that there is no provisions for enforcement of orders passed by the Lokayuktha, however agreed with the stand taken by the Lokayuktha.
6. The learned Senior Counsel appearing for the petitioners submits that this Court vide order dated 08.04.2005 disposed the writ petition with a direction to the respondents to pay the salary along with other benefits to the petitioners to which the petitioners are entitled under the law for the period during which they worked. It is also directed that the entire exercise shall be completed with a period of six weeks. The petitioners filed review petition and sought to review the order as the same was considered without the counter of the respondents. This Court vide order dated 10.03.2006 allowed the review petition and posted the same for hearing. The petitioners filed an additional affidavit bringing to the notice of the Court a Seniority list of //4//
work charged employees of Andhra Pradesh nativity was sent to Government of Andhra Pradesh on 23.02.1977. The learned Senior Counsel a
