Judgment:

This second appeal under Section 100 of the Code of Civil Procedure (“C.P.C.” for short) is filed aggrieved against the Judgment and decree dated 10.06.2011 in A.S.No.118 of 2006, on the file of the District Judge, Vizianagaram, confirming the Judgment and decree, dated 31.10.2006 in O.S.No.458 of 2001, on the file of the Additional Junior Civil Judge, Vizianagaram.

2. The appellant herein is the defendant and the respondents herein are the plaintiffs in O.S.No.458 of 2001, on the file of the Additional Junior Civil Judge, Vizianagaram. The 2nd plaintiff died during the pendency of the suit.

3. The plaintiffs initiated action in O.S.No.458 of 2001, on the file of the Additional Junior Civil Judge, Vizianagaram, with a prayer to direct the defendant by means of mandatory injunction to restore vacant possession of plaint „B‟ schedule tiled house to the 1st plaintiff within the time that may be fixed by the Court and if he fails to do so, get him vacated the same through the process of the Court at the costs of 1st plaintiff and permit him to realize the same as costs of the decree and to restrain the defendant, his men and servants from in any way interfering with the peacef
