ORDER:
This Criminal Appeal is filed by the State of Andhra Pradesh, represented by Public Prosecutor, High Court of Andhra Pradesh, under Section 377(2)(a) of the Code of Criminal Procedure, 1972 (for short, „the Cr.P.C‟), with a prayer to interfere with the quantum of sentence that was imposed by the learned Assistant Sessions Judge, Madanapalle, Chittoor District (for short, „the trial Court‟) in Sessions Case No.284 of 2006, dated 17.07.2008, contending that the quantum of sentence that was imposed against the respondents (accused) is not in accordance with the procedure.
2. The parties to this Appeal will hereinafter be referred to as described before the trial Court, for the sake of convenience. So, the respondents herein are the accused in the aforesaid Sessions Case No.284 of 2006, who faced trial for the charges under Sections 448 and 354 R/w.34 of the Indian Penal Code, 1860 (for short, „the IPC‟) pertaining to Crime No.39 of 2006 of Molakalacheruvu Police Station, Chittoor District.
