ORDER

This petition is filed under Article 226 of the Constitution of India, seeking the following relief:-

“….to issue a Writ of Mandamus, declaring the proceedings in RC D. 986/2014 Dt.31.03.2015 of 3rd Respondent and order in case D.Dis No.4E32421/15 Dt 12.06.2015 of 2nd Respondent as illegal, arbitrary, unconstitutional, unjustified and unsustainable and set aside them holding that the petitioner is entitled to retain the Pattadar Pass Book and title deed that are already issued to him for an extent of Ac.4.06 Cents in Survey No.867 of Gilakapadu Village, Rapur Mandal, Nellore District…”

The case of the petitioner in nutshell is that originally the subject land was purchased by the mother of petitioner under a registered Sale deed dated 07.11.1976 from one Vendor Nallavadla Venkata Subba Reddy.

While so, the 5th respondent who is the elder brother of the petitioner claimed that his mother gifted an extent of Ac.1.25 cents under Registered Settlement Deed dated 30.12.1998 and Ac.0.78 cents under Registered Deed dated 25.03.1996 in his favour. But, no such registered settlements deeds are executed by the father of 5th respondent. But, admittedly, their mother gifted an extent of Ac.2
