ORDER:

The civil revision petition is filed under Article 227 of the Constitution of India assailing the order dated 05.10.2016 in I.A.No.907 of 2016 in O.S.No.68 of 2015 on the file of Motor Accidents Claims Tribunal-cum-III Additional District Judge, East Godavari at Kakinada, whereby the petition filed under Order I Rule 10 and Section 151 of Code of Civil Procedure, 1908 (for short “CPC”) to implead the proposed respondents 3 & 4 therein as respondents 3 & 4 in the main petition, was allowed.

2. The brief facts which led to filing of this revision are that the 2nd respondent in MVOP No.68 of 2015 is the owner of Hero Honda motorcycle bearing No.AP 16 BL 0165 having purchased the same for Rs.35,500/- by availing vehicle loan of Rs.35,000/- from the revision petitioner company. At the time of availing said loan, the financier obtained a letter from the 2nd respondent stating that the financier will be paying insurance policy amount for a period of three years. Accordingly, the financier paid an amount of Rs.921/- to the 4th respondent herein for the 1st year i.e. 16.02.2009 to 15.02.2020.
