ORDER:

The Criminal Petition has been filed to quash the proceedings in FIR No. 155 of 2015 of Nandyal-I Town Police Station registered against the petitioner and another for the offences punishable under Sections 420, 406 and 409 IPC.

2. A private complaint has been filed by 2nd respondent for the offences punishable under Sections 420, 406, 409 IPC and the same was referred to the police under Section 156 (3) Cr.P.C. In pursuance of the reference, the Police registered a case in Crime No. 155 of 2015 on 04.08.2015.

3. Brief facts of the case are that 2nd respondent is eking out his livelihood by doing agriculture. He had taken land admeasuring an extent of Ac. 15-00 cents in Ayyaluru village on lease for the purpose of raising maize plants. He purchased 32 packets of kaveri maize seed variety K-50 starting from 30.04.2014 to 30.05.2014 from Shivanandi Traders (A-1 shop), near RTC Bus stand, Nandyal at the rate of Rs. 960/- each packet. Thereafter, he sowed the said seed in his leased land in the first week of June. Even after completion of more than two (2) weeks, the seeds did not properly germinate.
