ORDER:

The present Civil Revision Petition is filed by the petitioner being aggrieved by order dated 29.09.2022 in I.A.No.626/2022 in O.S.No.807/2016 on the file of the Court of the learned II Additional Junior Civil Judge, Guntur.

2. The petitioner herein is the defendant and the respondent is plaintiff. The respondent/plaintiff filed suit vide O.S.No.807/2016 for permanent injunction. In the said suit, the petitioner/defendant filed I.A.No.626/2022 under Order XXVI Rule 9 of CPC, 1908 praying the Court to appoint an Advocate-Commissioner to measure the property in D.No.485 in Plots No.179, 180 as per the title deeds of plaintiff and defendant and link documents and to measure the northern road in Plot No.179 and western road in Plot No.179 and 180 as per the title deeds and as per the layout plan of RTC workers Co-operative industrial house construction Limited, and to measure the property towards east of Plot No.179 and 180 in D.No.484/1, in Plot No.B-27, B-28 with the help of Mandal Surveyor to file report on the ground that, the suit for permanent injunction is filed on false and frivolous grounds and also with wrong boundaries and the property in D.No.485 and D.No.484/1 of Gun
