ORDER:

The short grievance of the petitioner is that, non-

consideration of his representation dated 31.08.2023 for issuance of pattadar pass book and title deed in his favour in respect of land admeasuring to an extent of Ac.2.97 cents in Sy.No.607/2 situated at Utukuru Village, Chinthakommadinne Mandal, Kadapa District.

2. Heard learned counsel for the petitioner and learned Government Pleader for Revenue for the respondents.

Learned counsel for the petitioner, in elaboration would submit that the petitioner made several representations to the respondent authorities requesting to issue pattadar pass books and title deed in his favour in respect of the subject property. But the same were neither considered nor replied by the authorities. He further submits that the petitioner also made attempts to submit application/representation through online, the same was not accepted. Thereafter, the petitioner herein submitted a representation dated 31.08.2023 to the 4th respondent requesting him to issue pattadar pass book and title deed in his favour in respect of his property. But, so far, the respondents neither considered the same nor acted upon. He further submits that it would suffice, if a direction is given to the respondent authorities to consider and dispose of the petitioner’s representation dated 31.08.2023 in accordance with law and prayed to pass appropriate orders in that regard.

On the other hand, learned Government Pleader for Revenue submits that for issuance of pattadar pass book and title deed, the petitioner has to make an application through online and as per the terms of G.O.Ms.No.3 dated 22.02.2012, no manual representation can be allowed for the said purpose. The petitioner, instead of making proper online application through mee-seva, the petitioner has straight away filed the present Writ Petition. As such, no indulgence need to be shown on the petitioner and prayed to dismiss the Writ Petition.

5. It is appropriate to mention about G.O.Ms.No.209 Revenue (EA & AR) Department dated 14.06.2017 and G.O.Ms.No.3 Information Technology & Communications (Infra)

Department, dated 22.02.2012.

6. The relevant portion of G.O.Ms.No.209 is extracted herein for better understanding.

“The Chief Commissioner of Land Administration, in his D.O.Letter read above, has proposed to introduce a new service to “Print Title Deed-cum-Pattadar Pass Book (PPB) through Mee Seva”. The Title Deed-cum-PPB are being issued at present through Mee Seva Service of “Mutation + Title Deed-cum-Pattadar Pass Book”.

7. Similarly, relevant portion of G.O.Ms.No.3 reads as follows:

“In order to achieve uniformity and efficiency, it is decided that the statutory services, which are delivered through Mee Seva shall not be delivered in parallel in the manual format and all the departments and officials should scrupulously follow the Mee Seva protocol. Separate initiatives and stand alone applications running as of now in various districts shall also be merged and subsumed in the Mee Seva.”

On perusal of the said G.Os., makes it clear that, a person, who intends to get statutory services, such as for issuance of pattadar pass book and title deed etc., has to submit an application through online by using Mee-seva services only.

8. Perused the record. It is not in dispute that the petitioner made manual representations to the revenue authorities requesting them to issue pattadar pass book and title deed in his favour in respect of his subject property. There is no doubt that in terms of G.O.Ms.No.3 Information Technology & Communications (Infra) Department, dated 22.02.2012, the petitioner has to make online application through mee-seva only.

It is the contention of learned counsel for the petitioner that when the petitioner made attempts to submit application online, the same was not accepted and hence manual representation was submitted.
