ORDER:

This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A10, seeking bail, in Crime No.04 of 2025 of Cyber Crime police station, Visakhapatnam Commissionerate.

2. A case has been registered against the petitioner and others for the offences punishable under Sections 111(2), 319(2), 318(4) read with 61(2) B.N.S and Sections 66-C, 66-D of I.T.A.-2000 and Sections 3 and

4 of the A.P. Gaming Act.

Case of the prosecution in brief, is that on 06.01.2025, on receipt of credible information, the S.I. of Police, Cyber Crime police station, Visakhapatnam along with staff conducted search at Flat No.610, Gayatri Towers, Opp. Water tank and pump house, backside of Polamamba temple, Doctors Colony, Pedawaltair, Visakhapatnam and found that A3 along with A1, A2, A4 and A5 conducting offline and online betting. As per the confessional statement of A3, he used to pool fund for the betting. Upon verification of mobile phones of A3, police found a total eighty two suspicious transactions.

4. Heard. Perused the record.

5. Learned Assistant Public Prosecutor submits that all the accused in the present crime are involved in gaming activities, placing bets in lakhs of rupees per game on cricket matches and investigation is not yet completed.

A perusal of the material available on record goes to show that the cyber crime police, on credible information, commenced the investigation on 06.01.2025 and the case is online cricket betting involving crores of rupees with number of bank accounts, UPI transactions including binami and hawala transactions. The petitioner was arrested on 18.01.2025 and got remanded to judicial custody. As rightly contended by the learned counsel for the petitioner, prima facie Section 111(2) of B.N.S. has no application in respect of the petitioner. This Court, considering the material on record, the nature of accusation, prima facie case and stage of investigation, is inclined to entertain the bail application of A10.

7. In view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioner herein, on the following conditions.

(i) The petitioner herein/A10 shall be released on his executing a personal bond for Rs.10,000/- (Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the Chief Judicial Magistrate, Visakhapatnam;

(ii) On release, the petitioner shall attend before the Station House Officer concerned once in a week i.e. on every Sunday between
