ORDER:
As per the directions of My Lord the Hon’ble the Chief Justice, this criminal petition has been allotted to this Bench by notice dated 25-03-2025 and the same is treated as part of the roster effective from 26-03-2025.
2. This criminal petition, under Section 482 of Bharatiya Nagarik Suraksha Sanhita, is filed by the petitioner seeking to release him on bail in the event of arrest in crime No. 37 of 2025 of S.N.Puram Police Station, Vijayawada City, registered for the offences punishable under Sections 338, 318 (4), 319 (2) and 340 (2) of Bharatiya Nyaya Sanhita (for short, ’B.N.S.’) and Section 66 (D) of Information Technology Act.
3. Today when the matter is taken up for hearing, Sri Harish Katipalli, learned counsel appearing for the petitioner, and learned Additional Public Prosecutor appearing for the respondent-State would submit that except the offence under Section 338 of B.N.S., all other offences alleged are punishable with imprisonment of seven years and less than seven years. So far as the offence under Section 338 of B.N.S. is concerned, no allegation is made against the petitioner attracting the said provision. In view of the said conjoint submission, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions.
4. The petitioner is, therefore, directed to surrender before the Station House Officer, S.N.Puram Police Station, Vijayawada City, on or before 25-04-2025. On such surrender, the petitioner is ordered to be enlarged on bail on his executing a personal bond for Rs.25,000/- with two sureties for the like sum each to the satisfaction of the Station House Officer, S.N.Puram Police Station. After release, the petitioner is directed to report before the Station House Officer, S.N.Puram Police Station, once in a week i.e. on every Monday between 10 a.m. and 1 p.m. until further orders.
5. Accordingly, the criminal petition is allowed.
