ORDER:
This writ petition is filed declaring the action of the Respondent in not releasing the amount of Rs.11,94,286/- vide M Book No.166/2021-22 payable to the Petitioner in relation to the works done vide Agreement No.141/2022-23 dated 16.08.2022 as arbitrary and illegal.
2. Heard learned counsel for both the parties.
3. Learned standing counsel for the Respondent passed on a copy of the signed instructions of the Commissioner, Chilakaluripet and as per the instructions, the Municipal Chairperson has accorded sanction under Genderal funds and accordingly tenders were invited through e-procurement. After evaluationof tenders, the works were allotted to the Petitioner. It is further stated that after completion of works, the Municipal authorities had prepared Bills for payment and due to financial priorities, the bills could not be processed. It is also stated that the Municipal authorities are processing the bills for uploaidng in CFMS portal on priority basis.
4. As there is no dispute to the execution of works and amount due to the Petitioner, the Writ Petition is disposed of, at the stage of admission, with the consent of both sides and placing the written instructions on record, with the following direction:
(i) The Respondent authorities are directed to pay the amounts due to the Petitioner within a period of four (4)
months from today.
(ii) There shall be no order as to costs.
As a sequel, the miscellaneous petitions if any shall stand dismissed.
