Headnote:This judgment concerns a petition filed under Section 482 of the Cr.P.C. seeking a stay on further proceedings in M.C.No.22 of 2017 pending in the Addl. Junior Civil Judge's court. The petitioner requests the court to stay the proceedings until the disposal of CRLP No.1619 of 2024. The court extended the interim order based on previous hearings and the arguments presented by advocates representing both parties.
Petition under Section 482 of Cr.P.C is filed praying that in the circumstances stated in memorandum of grounds of criminal petition, the High Court may be pleased to grant stay of all further proceedings in M.C.No.22 of 2017 pending on the file of the AddI. Junior Civil Judge-Gum-AddI. Judicial First Class Magistrate, Peddapuram, Kakinada District, (Erstwhile East Godavari District), pending disposal of CRLP No.1619 of 2024, on the file of the High Court.
Petition coming on for hearing, upon perus]'ng the Petition and the affidavit filed in support thereof and the earlier order of the High Court dt ll.03.2024, 01.04.2024 ,12.07.2024 & 13.09.2024 & 13.ll.2024 made herein and upon hearing the arguments of Sri A.K.KISHORE REDDY Advocate for the petitioner, public prosecutor for respondent no.2 and of SRI K.V.S.S. PRABHAKARA RAO, Advocate for the Respondent No.1 the Court made the following;
