This Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita , 2023, has been filed by the petitioner/Accused, seeking anticipatory bail, in connection with Crime N0.57 of 2024 of Cyber Crime Police Station, NTR district, registered for the offences punishable under Sections

318(4) and 319(2) of the Bharatiya Nyaya Sanhita , 2023 and Section 66-D of the Information Technology Act . 2000-2008.

2. Today, when the matter came up for hearing, none appears for the petitioner nor is there any representation made on her behalf. However, learned Assistant Public Prosecutor submitted that the offences alleged are punishable with

imprisonment of less than seven years.

3. Since the offences alleged are punishable with imprisonment of less than seven years, this Court directs the police to follow the procedure as contemplated under Section 35 (3) of the Bharatiya Nagarik Suraksha Sanhita , 2023 scrupulously, as per the guidelines enunciated in Arnesh Kumar Vs. State of Biharand another^

4. With the above directions, the Criminal Petition is disposed of.

5. As a sequel thereto, the miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
