Heard Sri K.Srinivas, learned counsel for the petitioner, Learned counsel for the petitioner contends that the petitioner is none other than the wife of the respondent/husband, due to the matrimonial disputes between both the parties, the petitioner/wife along with her daughter aged about 9 years are staying at Kalikiri, Chittoor District at her parent’s house.
Learned counsel for the petitioner would contend that to cause unnecessary inconvenience to the petitioner/wife, the respondent/husband has filed O.S.No.351 of 2025, on the file of the Principal Junior Civil Judge, Kadapa, under Order VII Rule 1 and Section
26 of the Code of Civil Procedure, 1908 r/w Section 307(3) of the Mulla Principles of Mohammadan Law, seeking for dissolution of marriage.
Learned counsel for the petitioner would further contend the petitioner/wife along with her daughter aged about 9 years has been residing separately at her parents’ house and depending upon the mercy of her parents. He would further contend that the distance in between Chittoor and Kadapa is approximately more than ISOKms and it i _ IS very difficult for the petitioner/wife to attend the divorce case proceedings before the learned Principal Junior Civil J Judge, Kadapa, on each and every adjournment without any male assistance and that she I IS constrained to file the present transfer petition.
Perused the record.
Considering the submissions made by the learned counsel for the petitioner and for the reasons mentioned in the accompanying affidavit, there shall be an Interim stay on all further proceedings including the appearance of the petitioner i.e., the respondent in O.S.No.351 of 2025, on the file of the Principal Junibr Civil Judge, Kadapa, till 12.09.2025.
Learned counsel for the petitioner is permitted to take out personal notice to the respondent through Registered Post with Acknowledgment Due and file proof of service before the Registry.
