JUDGEMENT:

The appellant is the Claimant in M.V.O.P.No.233 of 2009 on the file of the Motor Accident Claims Tribunal (Judge, Family Court- cum-III Additional District Judge), Vizianagaram and the respondents are the respondents in the said case.

2. Both the parties in the appeal will be referred to as they are arrayed in claim application.

3. The claimant filed a Claim Petition under section 166 of Motor Vehicles Act against the respondents by praying the Tribunal to award an amount of Rs.5,00,000/- towards compensation to the injuries sustained by the petitioner in a Motor Vehicle Accident occurred on 02.09.2006.

4. The case of the claimant is that on 02.09.2006 at 10.30 p.m., while he along with his friends were returning to his house in auto bearing No.AP 35 U 1455 and when they reached near the police station area of S.Kota, the driver of auto drove the vehicle in a rash and negligent manner with high speed and took a sudden turn, as a result of which the said auto turned turtle, resulting which he sustained severe injuries and the petitioner claimed an amount of Rs.5,00,000/- towards compensation.
