ORDER:

The Writ Petition is filed under Article 226 of the Constitution of India seeking to declare the inaction of the respondent nos.1 to 5 in removal of the unauthorized structures raised and the plant erected by the 6th respondent in Survey No.267/1 of Bhanumukkala village, Banaganapalle Gram Panchayat and Mandal, Kurnool District as unjustified, unconstitutional and contrary to the provisions of A.P.Panchayat Raj Act and the Rules framed thereunder and direct the removal of them and pass such other order or orders as the Court may deem fit and proper.

2. Heard learned counsel for the petitioner, learned Assistant Government Pleader and learned standing counsel appearing for respondents.

3. Learned counsel for the petitioner submitted that himself along with some others submitted a representation to the 3rd respondent to cancel the no objection certificate issued earlier to the 6th respondent on 27.5.2016 for proposing to install a hot mixer plant. Basing on the report and certificate issued by the 4th respondent, the 3rd respondent withdrawn the no objection certificate issued earlier to the 6th respondent.
