ORDER:
The present Writ Petition is filed by the petitioner under Article 226 of the Constitution of India, seeking the following relief:
“….pleased to issue a Writ, One in the nature of a Writ of Mandamus or any other appropriate Wirt, Direction or Order declaring the action of the respondent no.s 1 to 5 in not release of the sanctioned amount Rs.10 lakhs for financial assistance of my son POLINENI VAMSI CHOWDARY under the scheme of ‘VIDESHI VIDYA DEEVENA’ Application ID No.OV2019122211, which is illegal, arbitrary and unjust contrary to law and in violation of Article 14, 19, 21 of Constitution of India and principles of Natural Justice, and pass ….”
2. Heard Sri Peddi Vijay Bhasar, learned counsel for the petitioner, learned Assistant Government Pleaders for Social Wefare and Finance Departments.
3. Learned Assistant Government Pleader on written instructions dated 18.08.2023, submitted that, the petitioner’s payment is under process as the vigilance enquiry is completed recently in the month of April, 2023. As such, they could not pay the amount. Now, the bill is under process and they are likely to pay the amount and sought three (03) months time.
4. In reply, learned counsel for the petitioner submitted that, in similar set of facts this Court passed Order dated 28.06.2022 in W.P.No.17411 of 2022 wherein granted six (06) weeks’ time for payment and accordingly, prayed to consider the present case also in similar lines.
5. Taking into consideration the submissions of both the learned counsel, this Writ Petition is also disposed of, at the admission stage, in terms of the orders passed in W.P.No.17411 of 2022, dated
28.01.2022.
6. Accordingly, the respondents are directed to release the admitted/legally entitled amount to the petitioner at the earliest, and at any rate, within a period of six (06) weeks from the date of receipt of a copy of this order.
There shall be no orders as to costs.
Miscellaneous applications, pending if any, shall stand closed.
