JUDGMENT: (Per Hon’ble Sri Justice K.Sreenivasa Reddy

Accused Nos.1 and 2 in Sessions Case No.14 of 2014 on the file of the III Additional District and Sessions Judge, Srikakulam (for brevity ‘learned Sessions Judge’), are the appellant Nos.1 and 2, respectively.

2. Charge sheet was filed against accused Nos.1 to 3 for the offences punishable under Sections 302 and 202 read with 34 of the Indian Penal Code, 1860 (for brevity ‘ IPC ’). Vide Judgment, dated 19.04.2017, the learned Sessions Judge convicted the accused Nos.1 and 2 of the offence punishable under Section 302 read with 34 IPC in terms of Section 235 (2) of the Code of Criminal Procedure, 1973 (for brevity ‘CrPC’) and sentenced them to undergo rigorous imprisonment for life each and to pay a fine of Rs.10,000/- (Rupees ten thousand) each for the offence punishable under Section 302 read with 34 IPC . Accused Nos.1 to 3 are found not guilty of the offence punishable under Section 202 read with 34 IPC and they were acquitted of the said charge under Section 235 (1) CrPC.
