ORDER:

The present Civil Revision Petition is filed by the Petitioner/Plaintiff aggrieved by the Order dated 19.01.2023 in I.A.No.983 of 2022 in O.S.No.18 of 2018 passed by the Principal District Judge, Vizianagaram, in allowing the application filed under Order 1 Rule 10 of the Code of Civil Procedure to permit the respondent Nos. 1 to 5/proposed parties to come on record as Defendant Nos. 3 to 8 in the suit and for consequential amendment in the Plaint.

2. A suit was filed by the Petitioner herein/ Plaintiff seeking for specific performance of an agreement of sale dated 17.12.2015 or in the alternative to refund the earnest money with interest at 24% per annum. As per the Plaint, the Defendant Nos. 1 and 2 are the owners of the schedule property. After negotiation, the Plaintiff agreed to purchase the schedule property at Rs.13,000/- per cent and an agreement of sale was executed on 17.12.2015 to that effect. It was pleaded that though the Plaintiff is always ready and willing to perform his part of contract, as the respondents/Defendant Nos. 1 and 2 were not coming forward to execute the Sale Deed, the suit was filed.
