JUDGMENT: -

This Appeal, under Section 96 of the Code of Civil Procedure [for short „the C.P.C.‟], is filed by the Appellants challenging the decree and judgment, dated 22.07.1998 in O.S.No.201 of 1983 passed by the Principal Senior Civil Judge, Anantapur [for short „the trial Court‟].

2. The 1^st appellant herein is the sole plaintiff and Respondent Nos.1 to 18 herein are the defendants in O.S.No.201 of 1983.

It is to be noted here that during the pendency of the present appeal, the 1^st appellant/sole plaintiff died and his legal representatives are brought on record as appellant Nos.2 and 3 and further respondent Nos.1, 2, 6 and 17 died and their legal representatives are brought on record as respondent Nos.19 & 20; 21 to 23; 24 to 27 and 28 & 29 respectively.

3. The 1^st appellant/sole plaintiff filed the suit for partition and separate possession of the plaintiff‟s 1/4^th share in the schedule mentioned property and for costs of the suit.

4. Both the parties in the appeal will be referred to as they are arrayed before the trial Court.
