Requirement of making an online application through mee-seva for obtaining statutory services such as pattadar pass book and title deed.

ORDER:

Non-conducting of enquiry, in spite of receipt of petitioner’s legal notice dated 08.11.2023, for issuance of pattadar pass books and title deeds by incorporating the petitioner’s name in respect of the land admeasuring Ac.0.50 cents each in survey Nos.196/22, 196/23, 196/24 and 196/25 totalling to an extent of Ac.2.00 cents of Barnikam village, Parawada Mandal, Anakapalli District, the present Writ Petition is filed.

2. Heard Sri G.Rama Gopal, learned counsel for the petitioner, Sri E.Kumar, learned Assistant Government Pleader for Revenue appearing for the respondents.

Learned counsel for the petitioner, in elaboration to what has been stated in the affidavit contended that, the petitioner is the absolute owner and possessor of the subject land, got purchased the same under possessory agreement of sale from the unofficial respondent and others. Now, under the guise of the scheme ‘Jagananna Shaswata Bhu Hakku Mariyu Bhu Raksha Pathakam, the vendors of the petitioner influencing the revenue authorities and getting their names mutated in the revenue records and having come to know about the same, the petitioner has issued a legal notice dated 08.11.2023 to respondent No.3 to enquire into the issue and sought to issue pattadar pass book and title deed in the name of the petitioner, but the same was not considered by respondent No.2. He further submitted that, it would suffice, if a direction is given to the revenue authorities to act upon the petitioner’s legal notice dated 08.11.2023 and prayed to pass orders in that regard.

On the other hand, learned Assistant Government Pleader for Revenue contended that, the petitioner has to make online application through mee-seva/village secretariat as per the terms of G.O.Ms.No.3 dated 22.02.2012, as no manual representation can be allowed for the said purpose. The petitioner, instead of making proper online application through mee-seva, has straight away filed the present Writ Petition. As such, no indulgence need be shown on the petitioner and prayed to dismiss the Writ Petition.

5. In response to the same, learned counsel for the petitioner submitted that, a liberty may be given to the petitioner to make appropriate application to the concerned authority and prayed to pass orders in that regard.

7. It is not in dispute that the petitioner has not filed any application through mee-seva for issuance of pattadar pass books and title deeds. The petitioner got issued legal notice dated 08.11.2023 to the Tahsildar not to incorporate the names of the unofficial respondents in the revenue records in respect of the subject property and to conduct enquiry and to issue pattadar pass book and title deed in the name of the petitioner.

8. G.O.Ms.No.209 Revenue (EA & AR) Department dated 14.06.2017 and G.O.Ms.No.3 Information Technology & Communications (Infra) Department, dated 22.02.2012 are appropriate for the present purpose.

The relevant portion of G.O.Ms.No.209 is extracted herein for better understanding.

“The Chief Commissioner of Land Administration, in his D.O.Letter read above, has proposed to introduce a new service to “Print Title Deed-cum-Pattadar Pass Book (PPB) through Mee Seva”. The Title Deed-cum-PPB are being issued at present through Mee Seva Service of “Mutation + Title Deed-cum-Pattadar Pass Book”.

Similarly, relevant portion of G.O.Ms.No.3 reads as follows:

“In order to achieve uniformity and efficiency, it is decided that the statutory services, which are delivered through Mee Seva shall not be delivered in parallel in the manual format and all the departments and officials should scrupulously follow the Mee Seva protocol. Separate initiatives and stand alone applications running as of now in various districts shall also be merged and subsumed in the Mee Seva.”
