ORDER:

Today when the matter is taken up for hearing, learned counsel for the petitioner represented that proof of service is filed and the same was served on the respondents.

The petitioner filed the present petition under Section 24 of the Code of Civil Procedure, 1908, seeking to withdraw the case covered by M.V.O.P.No.143 of 2021 on the file of the Motor Accident Claims Tribunal-cum-District Judge, Kadapa and transfer the same to the Court of II Additional District Judge, Hindupur or any other Court in Anantapur District, for trial.

3. The case of the petitioner in brief is as follows:

The petitioner is the owner of the car bearing No. AP 02 BP 1719 and the 2nd respondent drove the car of the petitioner on 06.09.2020 and when he reached Tadigotla Village of Kadapa District, he found the 1st respondent fell down on the road, on humanitarian ground, he gave water to the 1st respondent and got him into conscious and as soon as he woke up the 2nd respondent went away.
