COMMON ORDER:
The respondent herein had filed O.S.No.269 of 2019 before the Principal Senior Civil Judge, Kadapa, against the father of the petitioner for partition of the suit schedule property, which consisted of about 260 sq. Yards of land in Kadapa District. The respondent is the sister of the petitioner’s father. While the said suit was pending, the father of the petitioner executed a deed of gift dated 02.06.2020 in favour of the petitioner herein, and thereafter, the petitioner commenced construction of the house in the suit schedule property. The respondent, having come to know about the execution of the deed of gift, had filed O.S.No.32 of 2020 in the Court of Principal Senior Civil Judge, Kadapa, for setting aside the said deed of gift. The respondent also filed I.A.No.14 of 2021 for an injunction restraining the petitioner herein from making constructions in the said suit schedule property. Initially, the trial Court granted an injunction in I.A.No.14 of 2021. Thereafter, the petitioner herein and his father sought to get the same vacated, and after hearing both sides, the trial Court made the said order of injunction absolute.
