COMMON ORDER :

As the issue involved in both the writ petitions is one and the same, these matters are taken up together for disposal by this Common Order.

The facts of the case in W.P.No.17714 of 2021 in nutshell are that the respondent authorities herein issued a Notification No.768/TRC-1/2018, dated 26.10.2018 inviting the applications for recruitment to the various posts including the post of Secondary Grade Teachers (Telugu). In pursuance of the said notification, the petitioner herein having requisite qualifications mentioned in the notification, made an application for the post of SGT (Tel) under sports quota (Ball Badminton) and the petitioner was issued with Hall Ticket No.18031440030339 and appeared for Online Text (Objective Type-Computer Based Test) conducted by the 5th respondent herein on 29.01.2019 and the petitioner herein successfully qualified online text conducted by the 5th respondent herein. Subsequently the respondent authorities issued Provisional Priority list as per G.O.Ms.No.74, YAT & C (Sports) Department, Government of Andhra Pradesh for the post of Secondary Grade Teacher (Telugu) in respect of Visakhapatnam District and in the said Provisional Priority List, the petitioner shown at Sl.No.6 and was given priority No.68. After publishing the said priority list, the petitioner came to that there are 8 number of SGT posts vacancies under Sports quota in Visakhapatnam District and the petitioner is eligible under Sports quota as he is a Ball Badminton player and participated several tournaments and Andhra State Ball Badminton Association issued a Certificate of Merit in the 16th Senior Andhra State Inter-District Ball Badminton Championship for Men held at Machilipatnam, Krishna District from 29.12.2001 to 31.12.2001. It is further stated that, as per procedure, after making the list of eligible sports persons, the respondent authorities published the Provisional Priority list as per GO.Ms.No.74 wherein the petitioner shown at Sl.No.2 (Priority No.40).

While the things stood thus, to utter surprise and dismay, the petitioner herein received a text massage on 09.08.2021 from the District Sports Authority with regard to file objections if any. Immediately, the petitioner herein verified the Web-Site of the respondents herein and it came to light that the respondent authorities published a Revised Priority list vide Lr.No.DSA/VSP/DEO/SGT(Tel)/08/2021 dated 05.08.2021 wherein the petitioner was Shown at SI.No.36 and he is not eligible due to the Ball Badminton game is not included in the G.O.Ms.No.74, dated 09.08.2012 at the time of DSC-2018 Notification. As per the G.O.Ms.No.7, dated 07.03.2019 Inclusion of Ball Badminton discipline for 2% Sports reservation to meritorious sports persons in direct recruitment in State Government/Undertakings/Grant-in-Aid institutions at all levels. Aggrieved by the same, the present Writ Petition is filed.
