ORDER:

Questioning the inaction of the respondents in granting disabled pension and white ration card (BPL) to the petitioner, the present writ petition came to be filed.

The case of the petitioner is that he is a physically challenged person and eking out his livelihood by doing coolie works. He was also issued certificate for person with disability with percentage of disability as 90%. Earlier, the petitioner used to receive pension of Rs.3,000/- per month under the scheme of disabled person. Thereafter, G.O.Ms.No.174 dated 13.12.2019 was issued issuing revised guidelines for sanction of pensions under the scheme of YSR Pension Kanuka in supersession of the earlier guidelines. As per the common eligibility criteria for sanction of all categories of pensions mentioned in the G.O.Ms.No.174, no family member should be a Government employee or pensioner. After issuance of the said G.O., the petitioner’s name was removed from the beneficiary of the scheme stating that the mother of the petitioner is receiving pension of her deceased husband, who is also the father of the petitioner, who worked as class IV employee in Municipal Corporation, Rajahmundry.
