ORDER:

This petition under Article 226 of the Constitution of India is filed seeking the following relief:-

“.... to issue a Writ of Mandamus, declaring the inaction of the 4th respondent in passing order on the petitioner’s application No.RMU012106681272, dated 07.05.2021 for mutation and granting of E-Pattadar Pass book-cum-Title Deed on the petitioner’s name for the agricultural landed property to an extent of Ac.1.52 cents in Sy.No.958/1 of Gangavaram Revenue Village in Santhanuthalapadu Mandal of Prakasam District as illegal, irregular and amounts to violative of the provisions of Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 and rules framed there under and offends Articles 14 and 21 of Constitution of India and consequently direct the 4th respondent to grant E-Pattadar Pass Books-cum-Title Deeds and also mutate the petitioner’s name in all online web land revenue records for the aforesaid land and pass such other order or orders.”

The case of the petitioner in nutshell is that one Tirumalasetty Subbaiah was the absolute owner and possessor of land related to the patta No.349, the lands available related to the said patta, in Sy.No.956/1 for an extent of Ac.5.59 cents and Sy.No.958/1 for an extent of Ac.6.36 cents jointly with Tirumalasetty Sriramulu and he sold remaining Ac.1.99 cents after his share 1/6th sold to Mannam Kotaiah, Narasimham, Raghavulu and others under registered sale deed in bearing Document No.143/1951, dated 14.02.1951.

The petitioner’s grandfather, Darsi Raghavulu was shown as Pattadar of the land for an extent of Ac.1.59 cents in Sy.No.958/1 and the petitioner is the successor of said Raghavulu, though the present subject land was sold away to Pappu Chandra Sekhar with other successors of Raghuvulu and again purchased the same under registered sale deed as aforesaid.

The respondents are under statutory obligation to consider and decide the petitioner’s application for granting of E-Pattadar Pass Book-cum-Title Deed and mutate his name in all online web land revenue records. Inspite of submission of application, the 4th respondent has not taken any action.

During hearing, learned counsel for petitioner, Mr.Naga Praveen Vankayalapati, limited his request to dispose of online application No.RMU012106681272, dated 07.05.2021 submitted by the petitioner before the respondent authorities through Mee Seva.

Learned Assistant Government Pleader for Revenue readily agreed to dispose of the said application, in accordance with law.

Recording the submissions of the learned Counsel for petitioner and the learned Assistant Government Pleader for Revenue, suffice it to issue a direction to the respondents to dispose of the online application No.RMU012106681272, dated 07.05.2021 submitted by the petitioner, within four (04) weeks from the date of receipt of a copy of this order, if the said application is incompliance of the mandatory requirement under the provisions of Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971(Act No. 26 of 1971) and rules framed therein.

With the above direction, this Writ Petition is disposed of.

No costs.

As a sequel thereto, interlocutory applications pending, if any in the Writ Petition, shall also stand closed.
