COMMON ORDER:

Since all the criminal petitions arise of one and the same crime i.e. Crime No.606 of 2020 on the file of Piduguralla Police Station and all the petitioners are accused in the said crime, this Court deems it appropriate to dispose of these criminal petitions by a common order.

2. These petitions are filed under Sections 437 & 439 of Code of Criminal Procedure, 1973 (for short “Cr.P.C”) seeking regular bail to the petitioners in connection with Crime No.606 of 2020 on the file of Piduguralla Police Station for the offences punishable under Sections 120-B, 121, 121-A, 124-A, 143, 144 and 149 of Indian Penal Code, 1860 (for short “IPC”) and Sections 16, 17, 18, 18-A, 18-B, 20, 21, 38, 39 and 40 of Unlawful Activities Prevention Act, 1957 (for short “UAPA Act”).

3. Criminal Petition No.1043 of 2021 is filed on behalf of petitioner/A-7.

4. Criminal Petition No.1173 of 2021 is filed on behalf of petitioner/A-15.

5. Criminal Petition No.1451 of 2021 is filed on behalf of petitioners/A-4 and A-11.

The case of the prosecution is that the respondent-police on credible information visited Julakallu village and apprehended A-1 who is a member of Peoples War Group (Maoists) indulging in violent activities against the law and seized revolutionary literature from his possession and also cash of Rs.10,000/- under the cover of mediators report. It is further case of prosecution that on 06.01.2021 they received information regarding movement of Maoist party sympathizers and supporters and the police along with mediators proceeded to Singh Nagar, Lona Center area of Vijayawada City and noticed the petitioner/A-7. On seeing the police when he tried to escape, the police apprehended him, interrogated him in the presence of mediators.

Insofar as the petitioner/A-15 in Crl.P.No.1173 of 2021 is concerned, the case of the prosecution is that A-1 who was arrested on 24.11.2020 has confessed that during November, 2017 and December, 2018 he along with A-3 attended meetings conducted by the alleged front organizations of Maoist party and at that time he came into contact with all other accused i.e., A-4 to A- 27 on different occasions at different meetings. The allegation made against A15 in the confession statement is that A-1 attended State conference of Virasam (Revolutionary Writers Organisation) held in the month of January, 2018 at Mahaboobnagar and he came into contact with the petitioner herein. According to A-1, the petitioner disclosed that previously she had worked for Maoists in Orissa area and thereafter she started working for the Committee for Release of Political Prisoners (CRPP) and the petitioner explained the political philosophy of Maoist party and encouraged A-1 to join in Maoist party.

Insofar as the petitioners/A-4 and A-11 in Crl.P.No.1451 of

2021 are concerned, the case of the prosecution is that they are responsible leaders of Pragatiseelaka Karmika Samakya (PKS);

frontal organizations of CPI (Maoist) party and they are supporting the activities of Maoist Party by propagating the ideology of the party, recruiting cadres to work in the party, instigating the youth and unemployed persons to join the party and squads led by it and to indulge in armed struggle activities. It is also stated that the petitioners are having connections with Maoist party leaders and meeting them now and then and thus, they are liable to be punished for the offences with which they are charged.

7. Learned Public Prosecutor for respondent-police filed counter stating that on receipt of credible information regarding unlawful assembly and doing unlawful activities, the Inspector of Police, Piduguralla Police Station and his staff with two mediators went to NSP canal bridge, Julakallu village of Piduguralla Mandal and caught hold of A-1, got recorded his confession and seized revolutionary literature from his possession under the cover of mediatornama, which is the basis for registration of present crime. Later the investigating officer arrested A-11
