The petitioner seeks a writ of mandamus declaring the action of

3rd and 4th respondents in passing the resolution No.12 dated 02.10.2019 for construction of Grama Sachivalayam in LP.No.38/95/R2 in R.S.No.82, 84/1 and 84/2 of Chinna Amiram Grampanchayat, Bheemavaram Mandal, West Godavari District as illegal, arbitrary and for a consequential direction to 3rd and 4th respondents not to make any constructions in the open space.

2. The petitioner’s case succinctly is that the petitioner is the Secretary of the Society by name Sri Tammiraju & Venkata Raju Nagar Welfare Association. Originally, the land in R.S.No.82, 84/1 and 84/2 admeasuring an extent of Ac.5.31 cents in Chinna Amiram Village, Bheemavaram Mandal, West Godavari District belong to G. Konda Raju and others. In turn, they executed a General Power of Attorney in favour of one Cherukuri Ramana Prasad who made an application to the Gram Panchayat for approval of the layout in the above survey numbers and the Director of Town and Country Planning has approved the layout in L.P.No.38/95/R1 and issued proceedings in RC.No.17499/93/R1 on 30.05.1995.
