ORDER:

This petition is filed under Section 438 Cr.P.C to enlarge the petitioner/A1 on bail in the event of his arrest in Cr.No.171/2020, dated 06.08.2020 on the file of RIMS U/G Police Station, Kadapa, YSR District, registered for the offences punishable under Sections

406, 407, 409, 420 read with 34 IPC.

2. The case of prosecution is brief is that the District Sand Officer, APMDC, YSR Kadapa District, namely P.Ram Mohan lodged a complaint alleging that he along with the SEB Members team, Mines Officers and the Revenue Officials along with the Panchayathdars verified and checked the Sand point situated in Sy.No.1043 of M/s Sri Vinayaka Excavation Works and found sand stock variation and came to a conclusion that it is a clear case of cheating, misappropriation and criminal breach of trust and thus a crime is registered against the petitioner and others in Crime No. 171 of 2020 of RIMS U/G Police Station, Kadapa, YSR Kada District for various offences referred supra.

3. The petitioner’s main contention is that the petitioner was authorized by a letter dated 06.12.2020 by A.P. Mineral Development Corporation Limited, Vijayawada vide reference APMDC/ Sand/De-Casting/Kadapa/2019-20/1471 a
