HON’BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.14747 of 2020 ORDER:

The writ petition is filed to declare the action of the respondents in not supplying the essential commodities to the petitioner’s Fair Price Shop No.1227044 of Duggimarri Village, Narpala Mandal, Ananthapuramu District without suspending or cancelling his authorisation as illegal and arbitrary.

The case of the petitioner is that he is a dealer of subject Fair Price Shop, and supplying the commodities to the card holders; the respondents have surprised his Fair Price Shop on 12.08.2020 and seized the ground stock on the false premise that there is variation between ground stock and the stock as per the statement drawn from E-PASS machine; without suspending or cancelling his authorisation, the respondents have stopped supply of essential commodities to his Fair Price Shop. Hence, the present Writ Petition.

The learned Government Pleader appearing for respondents submits that the petitioner’s Shop was inspected on 12.08.2020, but, so far no orders have been passed either suspending or cancelling the authorisation of the petitioner herein.
