THE HON’BLE SMT JUSTICE T. RAJANI Writ Petition.No.4179 of 2020 ORDER:-

This writ petition is filed seeking to issue a Writ of Mandamus to declare the action of the respondents, more particularly the respondent No.4, in proposing to conduct public auction of “Thrupu Tank for the year 2019-2020” vide R.O.C No.21/2019 dated 18.12.2019 contrary to the statutory Rules framed under G.O.Ms.No.343, Panchayat Raj (SAH.1) Department dated 10.04.1978 as illegal, arbitrary and consequently, direct the 4th respondent to grant leasehold fishery rights to the petitioner society in the “Thrupu Tank” as per the upset price of Rs.36,000/- fixed by the 2nd respondent.

The learned counsel for the petitioner is absent on

14.08.2020, but however, the matter is posted to this day making it clear that if the petitioner is absent today, the matter will be decided on that day. But the petitioner’s counsel is not present today also.

Heard the arguments of the learned Government Pleader, who appeared for the respondents. Hence, the matter is decided on merits.

The grievance of the petitioner is that the public auction for the subject tank is being conducted without following G.O.Ms.No. 343, Panchayat Raj (SAH.1)
