Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or a direction, more particularly one in the nature of Writ of Mandamus declaring the action of the respondents withholding the petitioner's gratuity amount to the tune of Rs.1,19,762/- while finalizing the pensionary benefits by the time of retirement under the guise of the pendency of the execution proceedings in Civil Court is illegal, irregular and arbitrary and violative of the provisions of Civil Procedure Code, Pension Rules and also offends Articles 14,21 of the Constitution of India and consequently direct the respondents to pay withholding gratuity amount to the petitioner and pass IA NO: 1 OF 2018 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased Counsel for the Petitioner:

ORDER:
Learned counsel representing Sri Mangena Sree Rama Rao, learned counsel for the writ petitioner would submit that the writ petitioner is no more, and in spite of his efforts, he could not get the details of legal representatives of the deceased/writ petitioner.
Therefore, necessary orders may be passed.
2. Considering the submissions made by the learned counsel for the writ petitioner, the writ petition is disposed of as abated. There shall be no order as to costs.
As a sequel thereto, interlocutory applications, if any, pending in this Writ Petition shall stand closed.
