THE HONOURABLE SRI JUSTICE D.RAMESH WRIT PETITION No.26950 of 2025 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

“….to issue a writ or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the Respondents proceeding with the mutation application filed by the Unofficial Respondent No.5 in pursuant to notice dated 01.08.2025 under Form-8 rule 19(1) of A.P. Rights in Land and Pattadar Pass Books Rules, 1989, without considering the objection of the Petitioner and demarcating the subject land in Sy.No.386 ofKotnur Village, Hindupur Mandal, Anantapuramu District, as illegal, arbitrary, high handed and violative of principles of natural justice and violative of Article 14, 21 and 300A of the Constitution of India and consequently direct the Respondents to demarcate the subject land in Sy.No.386 of Kotnur Village, Hindupur Mandal, Anantapuramu District, before proceeding with mutation application filed by the unofficial Respondent No.5….”

2. Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue appearing for respondent Nos.1 to 4.

The contention of learned counsel for the petitioners is that the respondents have issued Form-VIII notice under Rule 19(1) of the Andhra Pradesh Rights in Land and Pattadar Pass Books Rules, 1989 based on the application filed by the 5th respondent. Based on the said notice, the petitioners have also submitted explanation.

4. Considering the submissions, this Court has passed an interim order on 26.09.2025 directing the 3rd respondent- Tahsildar to examine the explanation submitted by the petitioners on 05.08.2025 before passing any orders. In view of the said directions, nothing survives in the writ petition.

5. As the grievance of the petitioners is that they have submitted the explanation/objections to the Form-VIII notice, the respondents are directed to consider the same before passing any orders on the application filed by the 5th respondent by providing an opportunity to the petitioners.

6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
