The Court made the following:

JUDGMENT: (per Hon’ble Sri Justice Ravi Nath Tilhari)

Sri D.Praveen Kumar, learned counsel appears for the appellant’s counsel and prays for adjournment for no reason.

2. The docket proceedings shows that on 07.08.2023, the following order was passed:

“ The appeal pertains to the year 2008.

2. O.S was filed in the year 2000.

3. Learned counsel for the appellant submits that fresh vakalat was filed, after seeking no objection from the previous counsel in the last week and prays for one (01) week time to prepare the matter.

4. Sri Abul Mohamad Subhani, learned counsel, representing Sri C. Sindhu Kumari, learned counsel for the respondent also prays for adjournment.

5. The proceeding sheet shows that the matter was adjourned previously also on some dates on the request of either of the sides.

6. Considering that the appeal pertains to the order 2008 and making it clear that no further adjournment shall be requested, list on 14.08.2023.”

3. It was made clear that no further adjournment shall be requested. Thereafter, on 14.08.2023, at the request of the appellant’s counsel time was granted to enable to file the English translation of documents in the regional language and to submit the paper book. Thereafter, so many dates were fixed and on many dates, the matter was adjourned at the request made either by the appellant’s counsel or on his behalf. The paper book has not been filed. The English translation of the documents in the regional language has also not been filed though a period of more than two years has passed. The appeal is of the year 2008.

4. Considering the aforesaid orders as also the act of the appellant in not complying with the orders for filing of the paper book and finding no justifiable reason to grant adjournment, we dismiss the appeal for non-prosecution.

5. Accordingly, the Appeal Suit is dismissed for non-prosecution.

There shall be no order as to costs.

As a sequel thereto, miscellaneous applications, if any pending, shall also stand closed.
