Petition under Article 226 of the Constitution of India praying that in the

circumstances stated in the affidavit filed therewith, the High Court may be pleased toto issue a Writ, Order or Direction more particularly one in the nature of 'Writ of Mandamus' declaring the action of the respondents in interfering with petitioner's House Site Plot bearing No 109 situated in Survey No141/3 of Konanki Revenue Village, Piduguralla Mandal, Guntur District, without following due process of law, as illegal, arbitrary, violative of Article

300-A of the Constitution of India, apart from being violative of principles of natural justice, consequently direct the respondents not to interfere with petitioner House Site Plot bearing No 109 situated in Survey No141/3of Konanki Revenue Village, Piduguralla Mandal, Guntur District, except in accordance with law, and to pass IA NO: 1 OF 2020 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents not to allot the petitioner House Site Plot bearing No 109 situated in Survey No141/3of Konanki Revenue Village, Piduguralla Mandal, Guntur District, to third parties, pending disposal of the main Writ Petition, and pass Counsel for the Petitioner:

The Court made the following Order:

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for the respondents.

2. This Writ Petition was filed questioning the action of the respondents in interfering with the petitioner's House Site Plot bearing No.109 situated in Survey No.141/3 of Konanki Revenue Village, Piduguralla Mandal, Guntur District, without following the due process of law.

3. On the other hand, the learned Assistant Government Pleader relying upon the written instructions of the 5^th respondent dated 27.01.2025 submits that the DK pattas were issued to the beneficiaries in the subject land on 25.12.2020. However, the DK patta will be granted to the petitioner with an extent of 3 cents in the subject layout as per the existing guidelines of the Government of Andhra Pradesh.

4. In view of the above said facts and circumstances, no further orders are necessary in this writ petition.

5. Accordingly, this Writ Petition is disposed of. Interim order if any deemed to have been vacated. There shall be no order as to costs. The written instructions of the 5^th respondent dated 27.01.2025 shall be made as part of the Court record.

As a sequel, Interlocutory Applications pending, if any, shall stand closed.
