Order:-

The petitioner is challenging the appointment of the 5^th respondent as

Anganwadi worker and seeks a direction to set aside the order of appointment

dated 28.12.2013 issued by the 4^th respondent.

2. The contention of the petitioner is that the petitioner secured more

marks as compared to the 5^th respondent in the 10^th class examination. It is

also submitted that though the 5^th respondent is not a native of Bakarapuram

Village, she had applied for the post of Anganwadi worker. It is submitted that

the notification issued by the respondent authority mandates that the

applicants should be residents of Bakarapuram Village for being eligible to

apply for the post of Anganwadi worker. It is submitted that the 4^th respondent

has ignored the basic criteria for selection and preferred the 5^th respondent

though the petitioner is more meritorious.

3. The respondent Nos.1 to 4 have filed a counter and it is stated in the

counter that the District Selection Committee had considered all the

applications and based on the performance of the applicants during the

interview, the Selection Committee awarded marks to the applicants as per

G.O.Ms.No.15. It is submitted that the 5^th respondent secured the highest

marks in the selection process and she was appointed as Anganwadi worker.

It is also submitted that the Selection Committee consists of senior officers

and no bias can be alleged against the petitioner. The marks awarded to each
