...RESPONDENT Appeal under Section 372/374(2)/378(4) of Cr.P.C praying that the High Court may be pleased to Aggrieved by the Judgment dated 08.10.2007 in C.C.No.6/2003 on the file of Additional Special Judge for SPE & ACB Cases, at Hyderabad convicting the accused and sentencing him to undergo RI for Six Months for an offence U/s. 7 and further convicted to undergo RI for One Year for the offence U/s. 13(1) (d) R/w 13(2) of P.C.Act, and to pay a fine of Rs.500/- under each count(Total One Thousands Only) and in default of payment of fine SI of 3 months , and the sentences shall run concurrently the appellant herein begs to submit this Memorandum of Criminal Appeal.

IA NO: 1 OF 2007(CRLAMP 1962 OF 2007 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to suspend the sentence of imprisonment made in C.C.No.6/2003 dated 08.10.2007 on the file of Addl.Special Judge for SPE and ACB Cases, Hyderabad and continue the petitioner on bail pending disposal of the above Criminal Appeal Counsel for the Appellant:

J U D G M E N T:

It is submitted that the appellant/convict is no more. He died on 15.11.2008. A copy of death certificate is also placed on record. No application filed by the legal representatives of the deceased-appellant to prosecute the appeal.

2. It is also submitted that the learned counsel for the appellant is also no more.

3. In that view of the matter, the appeal stands abated in accordance with law.

4. Accordingly, the Criminal Appeal is disposed of as abated.

As a sequel, interlocutory applications, if any, pending shall stand closed.
