nature of Writ of Mandamus declaring the action of respondents 3 and 4 in

submitted by me in respect of land in an extent of Ac. 0-71 cents in Survey

No. 76/8 of Daminedu Village, situate in Sri Balaji Registration District,

Renigunta Sub-District, Tirupati Rural Mandal, Chittoor District and

consequentially set aside the orders passed by 4th respondent in 35/2020

dt. 24-12-2020 which were confirmed by 3rd respondent in A.S. 13/2020 dt.

06-09-2021 and consequently direct the 3rd and 4th respondents to register

the document and to pass

Petition under Section 151 CPC praying that in the circumstances

stated in the affidavit filed in support of the petition, the High Court may be

pleased to direct the respondents 3 and 4 to register the document 35/2020

document No. P. 1031/2020, dt. 24-12-2020 in respect of Ac.0-71 cents in

Sy.No. 76/8 situated in Sri Balaji Registration District, Tirupati, Chittoor

District, Andhra Pradesh and to pass

The Court made the following Order:

Heard the learned counsel for the petitioner and the learned Assistant

Government Pleader appearing for the respondents.

2. This writ petition is filed questioning the action of the respondent

Nos.3 and 4 in refusing to register the document No.P1031/2020/35/2020,

dated 24.12.2020 submitted by the petitioner in respect of land in an extent

of Ac.0.71 cents in Sy.No.76/8 of Daminedu village, Tirupati Rural Mandal,

Chittoor District and consequently set aside the orders passed by 4th

respondent in 35/2020 dated 24.12.2020 which were confirmed by 3rd

respondent in A.S.No.13/2020, dated 06.09.2021 and consequently direct

the respondent Nos.3 and 4 to register the document.

3. The learned Assistant Government Pleader submits that the 4th

respondent filed counter affidavit but the same is under return in the registry

with some office objections. However, the learned counsel for the petitioner

submits that the petitioner made application to the 2nd respondent dated

12.08.2024 for deletion of the subject land from the prohibited list. In reply,

the learned Assistant Government Pleader submits that the same will be

disposed of by the 2nd respondent following the due procedure.
