Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased tomay be pleased to issue a Writ or Order more in the nature of Mandamus, to the declare the action of the respondents in not allotting marks to the petitioner for the previsions working as Asha for 10 years, for which effect certificate was issued, in the selection to the post of Asha, as illegal, arbitrary, unjust, Violative of Article 14 and 16 of the Constitution Of India, as well as in breach of principles of natural justice, and consequentially direct the respondents to award marks to the petitioner for the previsions working as Asha for 10 years, and accordingly appoint as Asha Worker as per as merit and pass such IA NO: 1 OF 2023 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased may be pleased to direct the respondents to award marks to the petitioner for the previsions working as Asha for 10 years, duly taking into consideration the service certificate dated: 02.12.2022 and pass such IA NO: 2 OF 2023 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to vacate the interim directions granted on 13.02.2023 in W.P.No.2737 of 2023 and dismiss the Writ Petition and to pass Counsel for the Petitioner:

ORDER:

1. This Writ Petition is filed to declare the action of the respondents in not allotting marks to the petitioner for the services working as Asha for 10 years, for which an effect certificate was issued, in the selection.

2. Heard the learned counsel for the petitioner and the learned counsel for the respondents.

3. Considering the contentions, this Court has passed an interim order on 13.02.2023. Subsequently, the respondents have filed their counter. According to the averments made in the counter, the petitioner has got 36.083 marks and was placed at S.No.138, and after taking objections from various persons on the provisional merit list, the case of the petitioner was considered by awarding 50 marks for the service rendered. In total, she got 86.083. Despite the same, but for the intervention of local leaders, they could not proceed with the finalization.

4. In view of the averments in the counters and the interim order passed by this Court on 13.02.2023, this Court is not inclined to go into the merits of the case, directing the respondents to consider the case of the petitioner along with the other candidates.

5. Accordingly, the writ petition is disposed of. There shall be no order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in the writ petition shall stand closed.
