ORDER:

The petitioner assailed the Government Memo dated

29.08.2011, wherein the respondents have initiated disciplinary proceedings against the petitioner by issuing the charge memo against the petitioner.

2. The petitioner has attended the enquiry on 07.04.2022 and submitted his written defense, but till today the respondents have not proceeded to conclude the enquiry even after lapse of 14 years, which is contrary to the G.O.Ms.No.91 General Administration (Ser.C) Department dated 12.09.2022, wherein based on the observations of the Division Bench of this Court, the Government has formulated and issued certain instructions to all the Principal Secretaries in the said G.O. In the said G.O, timelines were specifically fixed for simple cases should be disposed of within three months and complicated cases should be disposed of within six months, but in the instant case, even after lapse of 14 years, the respondents have not concluded the disciplinary proceedings which are pending against the petitioner.

3. Reply to the said contention, the learned Government Pleader has filed the written instructions from the Additional Commissioner, P.R & R.D. Even as per the written instructions, the enquiry is still pending. According to the said instructions after submitting the written defense statement, the respondents have appointed enquiry officer and presenting officer and the enquiry is going on.

4. Considering the above submissions and also on perusal of the written instructions, the writ petition is disposed of directing the respondents to conclude the enquiry as per the timelines stipulated in G.O.Ms.No.91 dated 12.09.2022 within a period of three months from the date of receipt of copy of this order after giving the opportunity of hearing to the petitioner. If the respondents fail to conclude the disciplinary proceedings within a period of three months, the respondents authorities are directed to consider the case of the petitioner for promotion to the post of M.P.D.O without reference to the charge memo dated 29.08.2011. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
