Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased toto issue an appropriate writ or order or direction more particularly one in the nature of WRIT OF MANDAMUS to declare the action of the Respondents in not granting permission to the Petitioner School to fill up the vacant aided posts as illegal, arbitrary, discriminatory and unconstitutional as also violative of Articles 14 and 16 of the Constitution of India and issue a consequential direction to the Respondents to forthwith grant permission to the Petitioner to fill up the vacant aided posts and pass such other or further order or orders as are deem fit and proper in the circumstances of the case.
IA NO: 1 OF 2017(WPMP 38258 OF 2017 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Respondents to consider the representation dated 29.07.2017 submitted by the Petitioner Counsel for the Petitioner:

The court made the following ORDER:-
The writ petition is filed under Article 226 of the Constitution of India, seeking the following main prayer:
“…..declare the action of the Respondents in not granting permission to the Petitioner School to fill up the vacant aided posts as illegal, arbitrary, discriminatory and unconstitutional as also violative of Articles 14 and 16 of the Constitution of India and issue a consequential direction to the Respondents to forthwith grant permission to the Petitioner to fill up the vacant aided posts and pass such other or further order or orders as are deem fit and proper in the circumstances of the case…..”
2. When the matter is taken up for hearing, learned counsel for the petitioner appearing through virtual mode submits that in view of the latest instructions dated 31.01.2026 of the 4th respondent/District Educational Officer, YSR Kadapa., furnished by the learned Assistant Government Pleader for School Education, the cause in the writ petition does not survive for further adjudication as the petitioner School along with its staff and assets was surrendered to the Government.
3. Recording the above said submission, the writ petition is closed by making the proceedings dated 31.01.2026 as part of record.
4. There shall be no order as to costs. As a sequel, all pending applications shall stand closed.
