O R D E R: (Per Hon’ble Sri Justice Cheekati Manavendranath Roy

This writ petition for habeas corpus is filed seeking direction to

the respondent police officials to produce the corpus, by name Naga

Vishnu Vara Prasad, who is the husband of the petitioner, before the

Court and then to set him at liberty.

2. Heard Mr. Mutyala Sobhanadri Naidu, learned counsel for the

petitioner, and the learned Assistant Government Pleader attached to

the office of the learned Advocate General appearing for the official

respondents.

3. When the matter is taken up for admission, learned counsel for

the petitioner would submit that the corpus was taken by the 4th

respondent – Station House Officer of Raidurgam Police Station,

Telangana State, only for the purpose of enquiry as a witness in a

crime registered against certain accused and thereafter, he was set at

liberty.

4. Learned Assistant Government Pleader appearing for the official

respondents vehemently opposed the petition, stating that when the

corpus was taken by the police of Telangana State, the petitioner has

unnecessarily filed the instant writ petition against the police of the

State of Andhra Pradesh.

5. In view of the submission made by the learned counsel for the

petitioner that the corpus is now at liberty and he was only taken for

the purpose of enquiry as a witness in a crime that was registered

against some other accused, nothing survives in this writ petition for

adjudication.

6. Therefore, recording the said submission of the learned counsel

for the petitioner, the writ petition is closed.

As a sequel, interlocutory applications, if any pending, in this

case shall stand closed. There shall be no order as to costs.
