Respondents in not taking any action for granting Minimum Time Scale in

terms of Judgment rendered by the Hon'ble Supreme Court in State of

Punjab Vs Jagjit Singh and others since the Petitioner is working for the

past 32 years as Part-Time Vocational Lab Attender/ Assistant is

illegal.arbitrary and violative of Article 14, 16 and 21 of the Constitution of

India and consequently direct the Respondents to consider the case of

the Petitioner for granting Minimum Time Scale to the Post of Part-Time

Vocational Lab Attender/Assistant and pass

Petition under Section 151 CPC praying that in the circumstances

stated in the affidavit filed in support of the petition, the High Court may

be pleased pleased direct the Respondents to consider the case of the

Petitioner for granting Minimum Time Scale to the Post of Part-Time

Vocational Lab Attender/Assistant by taking into consideration of the

judgement rendered by the Hon'ble Apex Court in a case of State of

Punjab Vs Jagjit Singh and others, as the petitioner is working for more

than 25 years on par with regular employees, pending disposal of the Writ

Petition and pass

ORDER:

The present Writ Petition is filed, under Article 226 of the

Constitution of India, seeking the following relief:

“to issue any writ, order or direction more particularly one in the

nature of Writ of Mandamus or an appropriate writ or order declaring

the action of the Respondents in not taking any action for granting

Minimum Time Scale in terms of Judgment rendered by the Hon'ble

Supreme Court in State of Punjab Vs Jagjit Singh and others since

the Petitioner is working for the past 32 years as Part-Time

Vocational Lab Attender/ Assistant is illegal, arbitrary and violative of

Article 14, 16 and 21 of the Constitution of India and consequently

direct the Respondents to consider the case of the Petitioner for

granting Minimum Time Scale to the Post of Part-Time Vocational Lab

Attender/Assistant and pass….”

2. Heard M/s K.Srinivasa Prasad, learned counsel for the petitioner

and learned Assistant Government Pleader appearing for respondents.

3. Learned counsel for the petitioner submitted that the petitioner is

stated to be appointed as part time Vocational Lab Assistant/Attender in

Government Junior (Boys) College, Palakol, West Godavari District on

21.7.1994 and is continuing to work as such, however, he has not been

extended minimum time scale of pay. Hence the Writ Petition is filed

seeking extension of minimum time scale of pay as attached to the said

post and placed reliance on law laid down by the Hon’ble Apex Court in

State of Punjab vs. Jagjit Singh and Others, 2026:APHC:4573

4. Learned Assistant Government Pleader appearing on behalf of the

respondents submitted that the Court may pass appropriate orders.
