Petition under Article 226 of the Constitution of India praying that in the

circumstances stated in the affidavit filed therewith, the High Court may be

pleased toPleased to issue an appropriate writ more in the nature of Writ of

Mandamus declaring the action of the Respondents more particularly the 1st

Respondent in not acting on the recommendation of the 2nd Respondent vide

E File No. 2060943, Dated 30-04-2025 for grant of permission to the Petitioner

for establishment of Nursing College and to run the courses of General

Nursing (GNM) despite completion of inspection as per the directions of the

2nd Respondent on 08-02-2025, as being arbitrary, illegal and violative of

Articles 14 and 19 (1) (g) of the Constitution of India besides being against

the principles of natural justice and consequently direct the Respondents 1

and 3 to grant statutory permissions to the Petitioner institution to run the

course of General Nursing (GNM) and issue such

Petition under Section 151 CPC praying that in the circumstances stated

in the affidavit filed in support of the petition, the High Court may be pleased

pleased to direct the 1st Respondent to grant approval to the Petitioner

institution for the course of General Nursing (GNM) as recommended by the

2nd Respondent through E File No. 2060943, Dated 30-04-2025, pending Writ

Petition, in the interest of justice and pass

cause in the present writ petition does not survive for further adjudication

and the matter becomes infructuous.

3. Recording the said submission, the Writ Petition is dismissed as

infructuous. There shall be no order as to costs.

As a sequel, miscellaneous petitions, if any, pending shall stand

closed.
