The petitioner challenges the appointment of respondent No.4 as a Junior Assistant on compassionate grounds by claiming that the certificates on the basis of which the appointment was sought and obtained were forged and fabricated.

2. In our opinion, the Public Interest Litigation is not maintainable. Reference in this regard can be made to the judgments of the Apex Court in Dr. Duryodhan Sahu v. Jitendra Kumar Mishra, [(1998) 7 SCC 273] and Gurpal Singh v. State of Punjab, [(2005) 5 SCC 136]. It would be, however, open to the petitioner to approach the learned single Judge by way of Quo Warranto, if so advised.

3. Accordingly, the Writ Petition (PIL) is disposed of. No order as to costs.

Miscellaneous Petitions pending, if any, shall stand closed.
