ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer:
“…to issue appropriate writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents 4 and 5 in calling me and my family members to the police station and detaining us and interfering in civil disputes and insisting me to settle the matter out of court with respect to the lands in an extent of Ac. 0.45 cents of land in Survey Nos. 55/20 Ac. 0.05 cents, Survey No. 18/26, Ac. 0.06 cents. Survey No. 8/23, Ac.0.07 cents. Survey No. 8/18, Ac. 0.04 cents. Survey No. 56/5, Ac. 0.12 cents. Survey No. 24/20 Ac.0.05 cents and Survey No. 18/31, A.0.06 cents totally admeasuring 0.45 cents forming one block and also Ac. 0.99 cents of land in Survey No. 24/5P admeasuring Ac. 0.63 cents and 0.36 cents in survey No. 25/2D failing which he will implicate me in criminal cases as illegal, arbitrary and unauthorized by law and is arbitrary and violative of our right guaranteed under Articles 14, 19,21 and 300-A of the Constitution of India consequently direct the respondents 3 and 4 not to interfere in civil disputes.…”
2. None represented on behalf of the petitioner. The present writ petition was filed questioning the action of the respondent-police in interfering in the civil disputes between the petitioner and the unofficial respondents and calling the petitioner and his family members to the police station.
3. Sri P.Ajay Babu, learned Assistant Government Pleader for Home, on instructions, would submit that basing on the complaint made by the mother of the 5th respondent, the petitioner was called to the police station and no crime has been registered against him, since, the subject matter is civil in nature.
The respondent police never interfered in the civil disputes between the parties.
4. Recording the same, this Writ petition is disposed of. However, the respondent-police are directed not to interfere in the civil disputes between the parties, except under due process of law. No order as to costs.
As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
